The Terms and Conditions for booking our vacation home are listed below. Please keep a copy of this information for your reference.

Reservations and Booking

The submission of the on-line booking form, or the signing of a booking form by you as Party Leader, confirms acceptance of the Terms and Conditions set out below and shall be binding on you and all the persons in your party intending to occupy the premises at the time of booking (or any subsequent amendments to that intention).

A reservation will only become a confirmed booking once we have received your booking deposit and we have sent a confirmatory email to you.

No parties where all guests are under the age of 21 will be accepted.

No pets are allowed under any circumstances. This condition is strictly enforced.

For the comfort of all guests, this is a no smoking vacation home. However, smoking is permitted on the patio/pool deck area. Please use the ash trays provided. This condition is strictly enforced.

To ensure your comfort, security and peace of mind, our home is registered with the State Authorities, is licensed and is maintained in full compliance with all relevant legislation.

Rental Period

The rental period generally consists of a Saturday to Saturday booking however, other periods are available with our agreement (please ask for details).

Stays of six nights or less will incur a cleaning fee of $120 US Dollars. This reflects the additional charges we have to pay to vacation home manager as a result of the increase number of 'Meet and Greet' and other services they have to provide.

The vacation home is available for occupation from 4.00pm local time on the day of arrival and must be vacated by 10.00am on the morning of departure. Vacating after 10.00am will incur a charge equivalent to one day’s rental charge unless previously agreed with us. You can pre-arrange earlier arrival or late departure if the vacation home is unoccupied, but again, only with prior arrangement with us or our vacation home manager.


Together with your completed booking, form a non-refundable deposit of 20% of the total cost of the booking (i.e. total excluding Pool Heat, the latter being optional) is due within five days of your reservation. Upon receipt of your deposit we will advise you that your reservation is a confirmed booking. Payment of the balance is due 10 weeks prior to the start of your vacation. Upon receipt, we will send out directions to our vacation home and details relating to access to the house.

Payment Methods

Payment of the booking deposit (and the balance due payment) can be made by Visa card payment through our vacation home manager (U.S. guests), PAYPAL (U.S. and U.K. guests) or cheque/check (U.K. and U.S. guests). Please note, a 4% charge will be made for payments made through PayPal and Credit card to meet the additional costs we have to pay to offer this payment method.

Security Deposit

Please note: Our home vacation home manager meets you at our home and will show you around the home and at that point you will have the opportunity to confirm that everything is in order. At that point, she will take your security deposit by credit card. She will also be at the home on the morning of your departure to do a home condition review and will also check you out.

You are solely responsible for any damage or breakages that may be caused to the vacation home or its contents by any members of your party (or any visitors/guests you invite into the house) during your stay. We require a security/breakage deposit of $425 US Dollars.

Claims on this security deposit may include: additional cleaning costs for removal of stains etc., arising from spillage and the like; excessive use of electricity (caused by leaving external doors open with the air conditioning on). We reserve the right to retain the security deposit (either in full or in part) to cover damage, missing inventory items or non-return of keys. Receipts will be provided for repairs/replacements in the unlikely event that retention of the security deposit arises.

Please note, Florida has a sub-tropical climate and care must be taken with food that is left uncovered and with garbage disposal. Any additional pest control measure costs that are incurred as a result of lack of care or non-observance of the garbage collection requirements by you may also be deducted from your security deposit.

We accept 'Fair Wear and Tear' but the determination of what is 'Fair Wear and Tear' is to be determined by our vacation home manager.

We reserve the right to pursue you for recompense where the cost of any damage, repairs or replacement of missing items caused by you, or any of your party (or visitors invited into our house by you during your stay) exceeds the value of the security deposit. We will require you to make payment of such recompense within 14 days of being served notice of this. In the event of non-payment we will seek legal remedy through the English or American courts.

Cancellation by guests

In the event of you needing to cancel this booking, the following conditions and charges will apply

  • Cancellation in the period from booking up until 10 weeks before the vacation/holiday is due to begin i.e. when the full balance is payable, will result in loss of the whole of the booking deposit.
  • Cancellation between 6 and 10 weeks of commencement of the vacation/holiday will incur a cancellation charge of 50% of the total cost of the booking.
  • Cancellation less than 6 weeks before the vacation/holiday is due to commence will incur a cancellation charge of 100% of the total cost of the booking.

We strongly advise you to take out insurance to cover any cancellation charges incurred as a result of illness, injury etc; This should be taken out at the time of booking. This is an in-expensive form of insurance and is well worth purchasing for a few $s or £s.

Cancellation by the owner

In the very unlikely event that personal circumstances necessitate cancellation of the booking, we will refund any monies paid by you (without any interest, compensation or consequential loss of any kind). However, we, or our vacation home manager, will always seek to try and relocate your booking to a vacation home of a similar or superior standard on the same community (development).

Force Majeure

We do not, nor does our vacation home manager, accept any responsibility or liability whatsoever for any loss or damage or alterations to the terms of this booking caused by events beyond our control including but not restricted to war, civil commotion, flight delays or cancellations, technical difficulties with transportation, alteration or cancellation of schedules by carriers, adverse weather conditions, fire, flood, industrial dispute or any other event beyond our control.

Safety and Security

To comply with State Fire and Safety Regulations, under no circumstances must more than the maximum number of persons identified on the booking form occupy our vacation home.

The swimming pool and hot tub is used entirely at your own risk. No diving is allowed in the pool and children must be supervised at all times whilst in the pool and hot tub areas. Glasses and crockery are not allowed on the pool and hot tub deck area at any time. Please use the plastic items provided.

Pool security fencing is available to be put into place for parties where young children make up part of the group. It is the responsibility of the adults in the party to ensure this safety feature is utilised. We accept no liability whatsoever for any pool or poolside accidents and neither does our vacation home manager.


In the unlikely event of a problem arising with the home during your stay, you must immediately contact our vacation home manager who will seek to resolve the matter at the earliest opportunity. Your satisfaction with our home is of up-most importance to us and should you consider that the matter is of a serious nature, we ask you to contact us directly immediately on +44 (0)1395 233406. Please note we cannot accept any responsibility for any issues that may have arisen which have not been reported to our vacation home manager during your stay.


We (and this includes our vacation home manager) do not accept any responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodations and amenities including the pool is entirely at your own risk. Children must be supervised by responsible adults at all times when using the pool. Glass or crockery is not permitted within the pool area.

We (and this includes our vacation home manager) cannot accept any liability for any loss of rental time due to travel problem, flight delays or cancellations, industrial disputes or any events outside our control, including any form of Force Majeure.

We (and this includes our vacation home manager) cannot accept responsibility for the sudden failure of equipment in our home but we will take immediate reasonable action to rectify any such failure upon notification by you of any problem. If the pool heater cannot reach optimum temperature due to the non-use of the provided pool blanket, or due to adverse weather conditions (this is un-likely as we have a gas rather than an electric heater) we and our vacation home manager, do not accept liability.

We and our vacation home manager reserve the Right of Entry to our villa at any time. This includes workers such as pool maintenance, gardeners etc.

Whilst all information supplied on the web site and other websites where our vacation home is advertised, is deemed to be correct to the best of our knowledge, it is understood that the information is supplied in good faith but is for guidance purposes only and does not form any part of the contract entered into as a result of placing a booking.

Code of Conduct

Orange Tree is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of Orange Tree. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbors after 10.30pm or before 07.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, residents of Orange Tree or damage to any property, we, or our vacation home manager, reserve the right to terminate your rental agreement immediately and forthwith. We will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action


This contract is subject to and shall be constructed in accordance with the laws of England and the partied hereto submit to the exclusive jurisdiction of the English Courts.
